What you may expect from this service, what it expects from you, and what an agent acting on your behalf makes you responsible for. Drafted from the product as it is built, with the commercial and legal decisions nobody has made left visibly empty.

Every factual statement below was written from what this product actually does, checked against the code that does it. None of it has been reviewed by a lawyer. It is published so that it can be checked and corrected, not because it is finished — and the blanks in it are blanks, not promises. Do not rely on this document as a binding agreement until it has been reviewed and dated.

English is the version that governs

This document is written in English, and the English text is the one with legal force. The Russian and Ukrainian versions are translations offered so that the same people who use the product can read it in their own language. Where a translation and the English text disagree, the English text is the one that means anything.

1. Who this is between

These terms are between the company that operates Agentfy.ai and you — whether you sign up for yourself or on behalf of a business. If you are acting for a business, you are stating that you may bind it.

That company and its address are not named here yet, for the same reason they are not named in the privacy policy.

2. Accepting them

Creating an account is how these terms are accepted. If you do not accept them, do not create one.

This text is a draft under legal review, published so that it can be checked. Until it has been reviewed and dated it describes intent rather than a concluded agreement, and the blanks in it are not silently resolved in anyone's favour.

3. Your account and your team

One person, one account, one email address. A team is the unit that owns things: the agents, their knowledge, the saved credentials, the conversations, and the records of the people who wrote in. Members of a team can see what the team owns.

You are responsible for who you invite into your team and for keeping your own sign-in details to yourself.

4. What the service is

A place to build agents that answer on your behalf, keep notes, hold your knowledge, and use the tools you give them. An agent runs when there is something for it to do, and the working files of a run do not survive it.

The product is under active development. Screens, limits and behaviour change, sometimes without notice, and some things described elsewhere on this site are not built yet. Where a page on this site says something is coming, it is not a commitment.

5. What you put in stays yours

Your instructions, knowledge, files, conversations and the records of the people who write to your agents remain yours. You give us permission to store and process them for one purpose: running the service you asked for, which includes sending what a turn needs to the providers named in the privacy policy.

We do not train models on your content and we do not move it between teams.

6. What you are responsible for

That you have the right to upload what you upload, and the right to hand an agent the accounts and keys you hand it.

That the people your agents talk to are treated lawfully. If your agent takes messages from your own customers, you decide what is collected about them and why, and you owe them whatever your law requires — a notice, a choice, an answer when they ask.

That everyone on a call you record has been told. The product gives you a sentence to say out loud and records whether you said you said it. It cannot ask them for you, it cannot signal them, and the tick-box is a record rather than a consent.

7. Other people's services

When you save a key for a shop, a mailbox or an API, you are letting an agent act there as you. What it does there happens on your account and under that provider's terms, and their terms are not ours to set aside.

Revoking a key is the fastest way to stop an agent acting somewhere, and the product lets you remove any credential at any time.

8. Tool servers you register

You choose the server, you accept where the arguments of a tool call travel, and you accept what those tools do when an agent calls them. We restrict which addresses can be reached from the platform; we do not vouch for what is at the other end of an address you allowed.

9. What an agent does is done by you

An agent is software following instructions you wrote, driven by models that are not deterministic. It will sometimes be wrong, and it can be wrong out in the world: a message sent, an order changed, a record written.

Look at what an agent can reach before you leave it running unattended, and keep its permissions as narrow as the job allows. Actions taken with your credentials are yours.

10. What you may not do

No unlawful use. Nothing that deceives or harms the people your agents talk to. No attempt to reach another team's data, no probing or overloading of the platform, and no reselling access as though it were your own platform without an agreement to do so.

No using an agent to record, transcribe or profile people where you are not permitted to.

11. Availability

The service is provided as it is and when it is available. It depends on third parties — the model, embedding and speech providers named in the privacy policy — and when they are unavailable, parts of this product are unavailable with them.

Whether any level of availability is promised, and what follows if it is not met, is not stated yet.

12. Money

What the service costs, how it is billed, what each plan includes, how usage is charged, and what happens to your data when a plan ends are not settled and are therefore not stated here.

13. Suspension and ending it

You can stop using the service at any time and delete what you have put in. We may suspend an account that is breaking these terms or endangering the platform or other users.

How much warning is given before a suspension, and how long you have to take your data out afterwards, is not stated yet.

14. No warranty

The service is provided without warranties of any kind, so far as the applicable law allows. Nothing it produces is professional advice — legal, medical, financial or otherwise — and neither is anything an agent says on your behalf or on ours.

15. Liability

The limit of our liability, and the exceptions to that limit, cannot be written without knowing which law applies and what the service costs. Both are blanks above, so this one is left blank too rather than copied out of somebody else's document.

16. Which law, and which court

Not settled. It follows from where the operating company is established, which is the first blank in this document.

These terms will change. How you will be told, how much notice you will get, and what happens if you do not accept a change has not been decided.
